Terms of Service

These Terms of Service ("Terms") govern your use of the 985 mobile application (the "App"), operated by Everr AI LLC ("Everr", "we", "us"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

• You must be at least 13 years old to use 985.
• 985 is an invite-based forum. Access is granted at the discretion of chapter sponsors and Everr.
• You agree to provide accurate information when creating an account, including your real chapter affiliation if any.

2. Your account

• You are responsible for safeguarding your login credentials and for all activity under your account.
• You may not share your account with other people or maintain multiple accounts to evade sanctions, blocks, or bans.
• If you suspect unauthorized access, email dan@bychance.dating immediately.

3. Acceptable use

By using 985, you agree not to:

• Post content that is unlawful, threatening, harassing, defamatory, hateful, sexually explicit, or that incites violence.
• Post content that infringes any third party's intellectual property, privacy, or publicity rights.
• Impersonate any person or entity, or misrepresent your affiliation with any chapter or organization.
• Post spam, advertisements, chain messages, or content unrelated to the chapter or board.
• Solicit, share, or distribute personal information of other members without their explicit consent.
• Engage in coordinated harassment or pile-ons against other members.
• Attempt to gain unauthorized access to other accounts, the database, or any part of the service infrastructure.
• Use the App to facilitate illegal activity, including but not limited to fraud, the sale of controlled substances, or the distribution of malware.
• Scrape, crawl, or harvest content from the App without our written permission.

4. Content you post

• You retain ownership of the content you post. By posting, you grant Everr a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content to other authenticated members of 985 for the purpose of operating the service.
• You represent that you have the right to post any content you submit.
• We may remove or hide content that violates these Terms or that we determine in good faith poses a risk to the community.

5. Reporting and moderation

• 985 includes a built-in mechanism to report content you believe violates these Terms. You can report any post or reply from its menu.
• You can also block other members. Blocked members' content will be hidden from your view.
• We aim to review and act on reports within 24 hours. Possible actions include leaving the content in place, removing the content, issuing a warning to the author, or suspending or terminating the author's account, depending on severity and context.
• We may take action without prior notice for severe violations. We may also reach out for additional context before deciding.
• Repeated or egregious violations may result in permanent termination of your account.

6. Termination

• You may delete your account at any time from Settings → Account → Delete account.
• We may suspend or terminate your account if you violate these Terms, if we determine your continued access poses a risk to the community, or for any other reason at our reasonable discretion. We will use good faith to explain the reason where appropriate.
• Upon termination, your authentication record is deleted, your profile is anonymized, and your reports, blocks, and notifications are purged. Posts you authored remain visible but are attributed to "Deleted member."

7. Disclaimers

The App is provided "as is" and "as available." We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. We do not endorse the content posted by members and are not responsible for member-to-member communications. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, Everr AI LLC and its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the App. Our total liability for any claim relating to the App is limited to one hundred U.S. dollars ($100.00).

9. Indemnification

You agree to indemnify and hold harmless Everr AI LLC from any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising out of your content, your use of the App, or your violation of these Terms.

10. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced inside the App and reflected in the "Last updated" date at the top of this page. Continued use after a change constitutes acceptance of the updated Terms.
